Terms & Conditions – Participant Agreement, Release and Acknowledgment of Risk Signature

This Participant Agreement, Waiver, Release, and Acknowledgment of Risk apply to all 2026 Sealy Outdoors, Inc. tournaments. All contestants are required to read and sign this agreement prior to participating in any Big Bass Splash® Tournament.

I acknowledge that I have read, understand, and agree to comply with all tournament rules and regulations. I further affirm that I have voluntarily completed and signed the Official Entry Form and submitted the required entry fee to participate in the Big Bass Splash® Tournament(s).

Release and Waiver of Liability – In consideration of being permitted to participate, I hereby waive, release, and hold harmless all other contestants; St. Jude Children’s Research Hospital; McDonald’s® Corporation; Valluzzo Companies, LLC; the cities of Guntersville, Scottsboro, Albertville, and Boaz, Alabama; all sponsors and their agents; Sealy Outdoors, Inc.; and all tournament officials, including but not limited to their respective employees, officers, directors, managers, members, insurers, and representatives (collectively referred to as the “Releasees”), from any and all claims, including but not limited to personal injury, accidents, death, or loss, damage, or theft of property arising out of or related to participation in the tournament(s). I understand that a portion of the Big Bass Splash® entry fee is donated to St. Jude Children’s Research Hospital, Ronald McDonald® charities, and/or select charities.

Insurance and Responsibility – I understand that boat insurance and liability insurance are my sole responsibility. I affirm that I have adequate health, accident, and liability insurance to cover any injury or damage resulting from my participation. If I do not carry such insurance, I accept full responsibility for any related expenses or liabilities.

Media Release – By providing my email address, I agree to receive communications from Sealy Outdoors, Inc. and a digital subscription to Texas Fish & Game Magazine. I grant permission to Sealy Outdoors, Inc., Valluzzo Companies, LLC, Official Radio Station(s), host cities, sponsors, and their agents to photograph, videotape, record, and/or broadcast my name, likeness, image, voice, and participation in the tournament(s) for promotional or commercial purposes, without compensation or royalties.

Polygraph and Prizes – If I place for any prize, I agree to submit to a polygraph examination, and I acknowledge that the results shall be final and binding. Failure or refusal to submit to such examination will result in disqualification. I understand that I am responsible for all applicable local, state, and federal taxes, as well as title, license, and registration fees associated with any prize awarded.

Venue and Legal Costs – Any legal action arising from participation in the tournament(s) shall be brought exclusively in State District Court, Jasper County, Texas, where the principal office of Sealy Outdoors, Inc. is located. If enforcement of this agreement requires legal action, I agree to pay all reasonable attorney’s fees and costs incurred by Sealy Outdoors, Inc. or any Releasee.

Authority to Sign – I affirm that I am authorized to sign this agreement on behalf of any contestant listed on this entry. Any contestant entered by another party has reviewed and understands all tournament rules and this agreement has given express permission for such signature and ratifies and agrees to be bound by this agreement and all tournament rules by signature and/or participation.

Acknowledgment – By signing, I confirm that I have read this entire document, fully understand its contents, understand that it affects my legal rights, and voluntarily agree to be bound by its terms. References to “I,” “my,” or “myself” and other first-person references shall include any minor child or ward on whose behalf I sign.

PARENT/GUARDIAN CONSENT (Participants Under 18) – I certify that I am the parent or legal guardian of the minor participant and consent to their participation. I agree to indemnify and hold harmless the Releasees from all liabilities, including those arising from the negligence of the Releasees, to the fullest extent permitted by law.
